Usually not up to whoever is prosecuting whether there is a jury or not, it is usually falling to the defense. Sometimes a jury trial is a double-edged sword, dragging people in, from their usual job and life on bullshit to get the same verdict at much greater financial expense and time consumed for no reason, can piss off the sentencing judge, so they may be better off to go with a judge's fairness, especially on something as cut and dried as this.
