Biden asserted that as of 2020, 38 states have ratified the amendment and stated it should now be recognized as “the law of the land,” according to a White House press release. So, 38 states did ratify the ERA but not before the deadline. That's one reason why it did not become an amendment to the Constitution. The other reason is that 6 states, Idaho, Kentucky, Nebraska, Tennessee, and South Dakota, first ratified the ERA amendment but later voted to rescind or otherwise withdraw their approval by the 1979 deadline. The deadline is dead a long time ago. If they want to try again, they can. Right now, they would not get more than 7 or 8 states to ratify it.

If the amendment itself didn't have a clause placing a time limit on its passage, he might have a point. However, it does, so the ERA is still not of any force or effect. Congress would have to pass a new ERA for submission to the states that didn't have such a restriction. I also wish that revoking a state's ratification could be disallowed given the extreme difficulty in passing amendments, but that is not how it works.

It seems quite clear that no one took that cut off date seriously in the States since the constitution gives no time limit to ratify an amendment, otherwise the states would not have continued to ratify it by their state legislators over the decades past the man made, forced, cut off.

It's whatever Democrat's choose for them to be, and it mostly depends on the movement of the moon as it passes between the sun and the earth on any given day that they choose for it to do so.
