I want someone to state their case how in principle it's ok for prostitution to be illegal and pornography to be legal.

aaaaaaaaAAAAAAAAAAAAAND GO!

I started a thread like this in the Romper Room. Did you get the idea from Family Guy?

Anyways, here's a devil's advocate. The difference is about who's paying. If, for example, the male talent paid the female talent to have sex with him in front of the camera, that would still be prostitution. But he's not the one paying her... the production studio pays both of them for their acting services. So pornography is more moral because the party dishing out the cash is not physically involved in said fuckage.

That's all I can come up with. :dunno:

Id have no problem with them both being illegal. But unfortunately pornography has first amendment protection. Which is completely ridiculous.

A good and reasonable case can be made that both should be Legal OR Illegal based on one's own view of morality and whether or not the Government should be involved in mandating and enforcing morality. I'm not going to make either case, since that's not what the OP's question was.

As to why one is Legal and the other is Illegal.... That's very simple. While the Bible may suggest that an individual has committed the sins of adultery and lust simply by looking at and/or thinking about having sexual relations with a member of the opposite sex, our laws are not focused on "thought crimes". They are instead based on physical actions. Therefore the sexual "crimes" that one may see in pornography are protected under the First Amendment to the US Constitution while the physical act of paying another individual for sexually gratifying acts can be regulated. Whether it should be or not is another discussion entirely.

the differences is porn is a first amendment issues

see: Jacobellis v Ohio, 378 US 184 (1964)

FindLaw | Cases and Codes

prostitution is NOT a first amendment issue.

that said, i think prostitution should be legal, regulated for the protection of both pro and customer and taxed.

But why isn't porn viewed as prostitution? 2 willing parties getting paid for sex?

I'd think prostitution should only be allowed in businesses with adequate security, but it's the same thing in my view as pornography.
