Of course they are Americans by birth. The parents register the birth at the nearest US embassy or consulate. The baby gets a US passport so the parents the baby through US Customs and Immigration.

How is that clear? This country had open borders in the 1800s. Basically anyone who wanted to come here could come and be an American. The only people excluded from that were natives and slaves. Hence the necessity of the 14th. The first restrictions on immigration didn't come until the Naturalization Act of 1906 which required Immigrants to learn English in order to become American.

It is a quote from the author of the amendment. Any court should understand what was meant by what the author said. So it is possible to ban anchor babies without changing the constitution.
