Yeah, silly us taking the Congressional intent and Obama's words at face value and focusing on the commerce clause argument.

In that we were vindicated. The expansion of the powers under the commerce clause would have effectively erased the 9th and 10th amendments and that was not allowed.






On the other hand what we already knew about how Obama would say anything and everything to maneuver around public opinion was also reinforced. IF it had been presented as a tax there is no way there would have been enough Democrats on board to pass it.

Obama's stubborn commitment to saying whatever it takes to get around the will of the people has been rewarded in the short term. America now gets to decide whether they want to reward it in the long term. We'll see how that goes.
