Its like any other law, the max penalty is usually much more severe than what the person is eventually given.

If he has a clean record, then it will probably be adjudicated pending dismissal.

What should be done, is simple, take the boy to the woodshed! Make sure he can't sit down for a few days, and tell him to put on a shirt, pull up his pants and act like he is somebody, not some thug.
