During that summer, a month into Brown's tenure on the D.C. Circuit, Sandra Day O'Connor announced her retirement from the Supreme Court and Brown's name was floated as a replacement.

Biden, though, appeared on CBS’s "Face the Nation" to warn that Brown would face a filibuster if nominated.

"I can assure you that would be a very, very, very difficult fight and she probably would be filibustered," Biden said. Asked by moderator John Roberts, "Wasn’t she just confirmed?," Biden said the Supreme Court is a "totally different ballgame" because "a circuit court judge is bound by stare decisis. They don’t get to make new law."

She would have been the first Black woman nominated to the Supreme Court.

If you'd like to make the case that Senator Biden would have gladly approved Brown for a SCOTUS seat, I'm sure lots of people would like to hear it.

The nomination that was threatened with the filibuster was not to the SOCUTS, but to the DC Circuit court.

She was not talked about for SC appointment. This took place in 2003, there was no opening on the SCOUTS in 2003. There would not be till 2005

What Biden threatened was unprecedented. There has never been a successful filibuster of a nominee for associate justice in the history of the republic. Biden wanted to make a Black woman the first in history to have her nomination killed by filibuster. Bush eventually nominated Samuel A. Alito Jr.

Judge Brown was more qualified than Jackson, but because she was too mainstream for Biden and the crazy left Dems they blocked her before she could even get a hearing.

That Face The Nation episode aired in July, 2005. What's your proof that Janice Rogers Brown was on Bush's short list at that time...?
