Probable cause comes into play if it is reported or otherwise suspected that the person has firearms in his possession. Otherwise, the authorities are theoretically able to search everyone's home to see if they have, say, bombs or bomb making materials because no one is allowed to possess a bomb.

Our gun problem, Tommy, isn't normal people who own guns for self defense, hunting, and sport.....our problem is the democrat party. They have judges, politicians, and prosecutors who keep letting repeat gun offenders out of jail on bond, and out of prison with short sentences. This isn't made up, it is actually happening...and we have to ask why they do this? They are the ones who complain loudest about gun crime....yet they keep letting violent, known...I repeat, Known, gun offenders out of jail and prison...

No, no one is decling to enforce the law. If the man had tried to purchase a weapon, the system would notify the merchant that this person is barred from owning firearms and thus would decline the sale.

However, there are ways to procure firearms other than by legal means. There’s no way to prevent someone from purchasing a firearm illegally if they are determined to do so and the law stipulates that they cannot routinely search his home, vehicle or person without probable cause. In other words, they cannot get a warrant to search unless they have evidence to suggest he actually has firearms in his possession. They cannot search his home simply because he’s not allowed to own them.

Simply not being allowed to own firearms is no indication that a person has firearms or will ever attempt to procure one and so is not a reasonable justification for a search. This is where probable cause comes into play.

You’re also familiar enough with the American Constitutional system to know that random, unwarranted searches by the state are illegal, that the police are agents of the state and subject to Constitutional restrictions, and that absent evidence that a prohibited person is in possession of a firearm, any search or seizure would likewise be illegal.

You’re as bad as most conservatives on this site – the same disingenuous ‘arguments,’ the same propensity for sophistry.
