The President is the head of the Executive Branch. As such, he is the utmost authority on classification of documents.
Yes, trump revealed classified top secret signet information to the Russians who visited him in the oval office, exposing information given to us in secret, by an ally ...a foreign government, and everyone WAS SHOCKED!!!
We have never had a President do that, without checking with the agency that classified it top secret, so to make certain it did not give away our spies and allies gathering the information....putting them in danger.
It was written off to trump being new, and not knowing any better.
Jim, the law states the presidential records are ours, not Trumps, but he does have the power over the records on who gets to see them before the 5 year mark, unless they are needed for an investigation or another need....by the residing president, or the doj or congress if there is a need or an investigative need..
As far as top secrets by the case load, trump can not wave a wand declassifying them all in a lump sum.
He has to reclassify one document at a time, and he HAS TO TELL SOMEONE so each individual document can be MARKED declassified in our govt systems....everyone in the govt working with these top secret documents need to know they've been declassified, and the procedures require Trumps signature for each document he declassified.
Yes he can declassify, but he also has to do so with caution, to protect us and our human resources out there, gathering the info.
From my understanding, trump had all of his Whitehouse presidential records boxed up and sent to his white house residence, and then to his Mara lago resort.
When did he reclassify the documents to unclassified? Did he TELL anyone? Who? Did he have their classified status changed, with his signature and date of when declassified?
Without such, the documents remain classified.
Oh, and it was not until the raid, did we hear about his claim that all of the presidential records he took with him, were automatically declassified when he sent them to his residence.
Trump NEVER claimed he declassified them all with the National Archives trying to get all of the records back, that he took. Why didn't he?
But please note!
The search probable cause crimes, did not involve his presidential records....the three alleged crimes have to do with
above top secret documents with national security risks that he illegally took with him.....
