You're still not getting it. A judge can tell jurors to disregard things or not consider things but they still do. Taking the fifth carries with it the appearance of guilt no matter what any judge may say because of the horrible people who have used it in the past. No lawyer is ever going to tell an innocent man to take the fifth because of how it makes them look.If taking the 5th had a bearing on guilt, some judge, somewhere, would give that as a jury instruction.
