Tariffs are taxes importers pay. It has nothing to do with foreign policy and they were not designed to be a tool of foreign policy.

Negotiations happen before the court renders its judgement. And they just ruled one side committed an ILLEGAL act.

If tariffs were paid by the foreign companies, then the president would have the authority to tax them.
But tariffs are paid by the americans that import. And only congress can tax Americans.
