Pretti made offensive contact during the interaction. That's assault on LE per your provided and quoted directly from your definition.

The first time he was pushed off the streets. he stood their arguing and bumping chests with the officer = Offensive contact.

The second time he came back he placed himself between officers and a woman making contact.

More over the whistle blowing in close proximity is offensive contact and assault per your provided legal definition

No physical injury is required, but the actor must have intended to cause a harmful or offensive contact with the victim and the victim must have thereby been put in immediate apprehension of such a contact."

That’s not assault. Pretti was pushed off the streets, meaning that the officer was the one initiating contact.

Clarify. If you get pushed off the street by an officer and push him or bump your chest into him in return that's assault.

The one getting pushed isn’t guilty of assault.
