Yes, Pretti had "stopped" fighting because he was blinded and in pain from multiple application of OC spray to the face and was face down being restrained by 4-5 DHS Agents who were dragging him around and manhandling him as he delt with the pain, blindness, and breathing caused by the spray.

He didn't stop fighting until the bullets hit him. He could have avoided that by stopping sooner.

I'm sure you have seen the video of him spitting at ice officers and kicking their vehicle the previous week. I don't know how to explain that other than mental.Illness or drugs.

What could he have thought kicking their vehicle would accomplish?

If I had to guess, I would guess suicidality, and a desire to be a martyr. But we will never know because whatever he was trying to do, he was successful.

The latest report from the Federal government supports this was an illegal use of deadly force. After He was disarmed there was no imminent threat. 5 seconds after the gun was taken away he was shot by two agents. There were no furtive movements, and he was restrained, violently resisting yes, but unarmed. The agents screwed up.

In context Pretti had a violent encounter a week before breaking his rib, went to the protest/riot with a loaded gun, and was looking to get even. An act of total stupidity. But the use of deadly force was not justified.

There is no evidence that Pretti's gun was discharged.

Have you seen a ballistics report? Maybe a crime scene photo of the shell casing? How about bullet damage to the road surface.

Now think through this.

The video's do not show a discharge. The officer (I'll call him Officer Gray for his coat) that recovered the firearm left the scrum with the firearm in his right hand.

Human nature and especially for law enforcement, instinct is going to be to look in the direction of a firearm being discharged to assess the situation and any possible threat.

Now watch the videos, at the time the first shot is fired, Officer Gray looked over his shoulder to his LEFT because that appears to be where the sound comes from. He was holding Pretti's firearm in his right hand, if that gun had accidently discharged he wouldn't have looked left, he would have looked right at the weapon in his hand that had just fired.

The "accidental discharge" theory make no sense. As a matter of fact video analysis shows that the officer in the blank mask behind Pretti that had just watched Officer Gray exit the scrum was the first to fire based on sound, pointing the weapon, and his arm recoiling do to his discharge.
