How the hell is the Constitution being nullified? Nobody is stopping them from gathering, they are just wanting them to do it safely. It's not the building that makes the church, it's the people in the congregation.

That's a temporary freeze on the order.

Two Baptist churches, a minister and a Christian revival group filed the federal lawsuit seeking to immediately block enforcement of rules covering religious services within the Democratic governor's executive orders. The latest order still largely prevents most faith organizations from holding indoor services attended by more than 10 people.

Cooper’s office has said the newest order stating permitted services may “take place outdoors unless impossible” carries only a narrow exception, such as when religious activities dictate they occur indoors with more people.

What precisely does the 1st amendment say? And which governors prohibited worship? Just because congregating en mass is prohibited for health and safety, that does not prohibit worship.
Because government cannot dictate the manner in which people worship, and the right of assembly is in the First for the express purpose of keeping government authority limited.

If government can dictate the manner in which people worship, they can then dictate HOW people worship and that is establishing a religion.

Government is dictating that large groups are a danger to themselves and to others. All large groups are included and religion is not being singled out

That is not to say America is required to submit to Sharia outside of that specific religious practice, nor that practitioners can exercise certain aspects illegal in society, same as the old Christian practice of burning witches is no longer permitted.

An example: a weather emergency. Yes, your right to peaceably assemble may be temporarily suspended.
