Judge Rules 8647 Is Free Speech

Today, a federal judge agreed and enjoined the National Park Service from revoking their permit based on displaying an 8647 flag. The reasoning was quite simple. The statute banning threatening speech applies only to “true threats” and no reasonable person could believe this flag displaying “8647” conveyed a true threat against Trump. I was 86ed out of a bar once when I was in my early 20s. I was wild back then. It simply meant that I had to leave the bar and not come back. The bartender wasn't threatening to kill me.

So all that folks are saying is that they want to kick Trump out of office and make sure he never comes back. Seems like a reasonable request to me.

I agree. That's the only way I've ever seen the phrase used--in a bar context. There was a thread when the stones were first discovered that people argued for half a day that it was a term for assault. I was under the impression that it went to the alcohol content of most common booze---and the abuse of it. LOL, fits with your experience. I've been fortunate and have never been 86ed.

This is how the law always worked. Now with the president things are generally a bit tighter but......

If I call someone and say "I'm going to beat your arse" no real threat. If you are standing on someone's porch beating on their door yelling "I'm going to beat your arse" then it's a threat.
