Laws Regarding Classified Documents

If he declassified it, then it must be released when requested through FOIA.

That’s what declassification means.

Any damage to national security as a result is on him.
You somehow believe we have to jump at every command from the Federal government. What do you think lawyers are for?

Well, that's the interesting thing about the NYT FOIA case. The court ruled that even though Trump tweeted classified information, that did not mean it was therefore declassified by him. They explained there is a rigorous process by which a president must go through to declassify information, and tweeting is not it.

Trump cannot just utter some magic words. The president has to formally notify all parties who are impacted by the information before he can declassify it.

And as I have proven unequivocally, Trump is not claiming in court that he declassified the Top Secret documents in his possession. He is only telling the stupid credulous rubes that, and they swallowed that shit whole.

There is a procedure for that process, retard. He can't just magically wave his hands and declare them declassified.

You need to read the topic before making more a fool of yourself.

Trump is lying right to your dumb submissive cuck faces.
Yes, he can. The Constitution and Supreme Court said so. Do your research.

Show us the link to that information.

She had a private server in her basement,
They had an email server set up in their home for their private domain. It was not connected to the secure government network or have access to classified documents

which had access to ALL classified documents. ALL of them
That's Nucking Futz, man.
They ruled she was extremely careless in handling classified information. Oh, that's right you said she didn't have any classified information.

Demonstrably false. Mere moments ago you replied to "... The classified information was embedded within several e-mail chains."

Trump's lawyers declared all classified records had been turned over.

That was a lie.

That's why the search warrant was issued. The government tried all other means to get the documents back and so Trump left them no choice.

Do try to catch up, tard.

Trump had a chance to challenge the subpoena. Instead he said he complied with it but we all know that was a lie.

One thing you can’t do is lie.

Is "Do your research" the tard answer to everything after their ass has been handed to them?

Your idea of "research" is listening to Trump and his media puppets and bleeving every lie they tell you.

'
I showed you the court case which proves you wrong, dipshit.

Tough shit. The current administration is lying to the American people every damn day. Fuck you.

Oh, wait a minute. Now this is interesting. Lawmakers now want to pass laws regarding classified documents because current laws are "vague and toothless".

"While the Department of Justice and President Trump’s lawyers battle in Florida courtrooms over how the former president handled records from his White House, a group of advocates and members of Congress is working to fix the obscure 1970s law they say let the behavior go unchecked.

Critics say the “outdated, vague and toothless,” law needs to change"

So, once again, they are going after Trump over VAGUE AND TOOTHLESS laws currently on the books. Translation: They can't indict Trump over vague and toothless laws but Biden's "Independent" DOJ wants to put him through the ringer anyway for political purposes, just before the midterms. Kind of reminds you of Congress wanting to pass fixes to the Electoral Vote Act because that law was also vaguely worded.

The above link is from USA Today, not Fox News.
Who says they can't indict him?

Just hide and watch.

The Supreme Court ruled that the President has the power to declassify whatever he wants.

Once more, for the willfully blind tards:

But Plaintiff does not actually assert—much less provide any evidence—that any of the seized records bearing classification markings have been declassified.

Because declassification, even by the President, must follow established procedures, that argument fails.

So? This administration lies every day to the American people.

The Supreme Court determined in its 1988 decision on Department of the Navy v. Egan that the president’s power over classified information comes from executive authority granted by Article II, Section 2 of the U.S. Constitution, which says, in part, that the “President shall be Commander in Chief of the Army and Navy of the United States.”

“His authority to classify and control access to information bearing on national security and to determine whether an individual is sufficiently trustworthy to occupy a position in the Executive Branch that will give that person access to such information flows primarily from this constitutional investment of power in the President, and exists quite apart from any explicit congressional grant,” the Supreme Court decision reads.

Though there aren’t specific protocols that the president must follow to declassify a document, federal courts have ruled that they will “refuse to recognize what they consider to be an inference of declassification,” McClanahan said.

The U.S. Second Circuit Court of Appeals wrote in a 2020 decision about whether statements made by then-President Trump declassified the existence of a CIA program that “declassification, even by the president, must follow established procedures.”

You're kidding, right, tard?

I already provided the links. I just repeated the relevant quotes in the hopes they will penetrate your incredibly stupid and dense skull.

You mean to tell me you did not recognize them from when I first showed them to you?!?!?

You truly are willfully blind!

So once again:

But Plaintiff does not actually assert—much less provide any evidence—that any of the seized records bearing classification markings have been declassified.

Because declassification, even by the President, must follow established procedures, that argument fails.

Regardless of whether or not the documents Trump was hiding were classified, the laws which the DOJ is accusing Trump of violating have nothing to do with their classification.

Do your research, tards. Trump is lying to you.
