Assault Weapons Ban would be unconstitutional. "A State Militia must be maintained and well regulated"

The United States constitution clearly states that a "States militia must be well regulated and maintained." A weapon of a "States militia" is an assault rifle. Any ban would violate the United States constitution.
Which state is it that has a militia?

Almost all states.
If you read the state constitution, most say something like that all male adults are automatically part of the militia.
That means they can be called upon at any time, for things like a posse.
But remember back then there were no police, so people were also expected to protect their own possessions.
Proof?
"Well regulated"?
This is the common law for the common defense:

The defense and protection of the state and of the United States is an obligation of all persons within the state. The legislature shall provide for the discharge of this obligation and for the maintenance and regulation of an organized militia.

The National Guard has many assault rifles and many other cool weapons. They are the State Militias, who were always ultimately under the command of the CiC. Not the private gun clubs.

"A well regulated Militia," means trained in the art of war.
That comma in the 2nd Amendment must short circuit the lefts brain or something because you people always leave out everything after it.
It does nothing of the kind; it only proves the right wing has nothing fallacy of appeals to ignorance.

When the second amendment was written well-regulated does not mean what it means now
In working order as to be expected

The founders considered the people the militia the government doesn't have right therefore the second amendment does not pertain to government

Go back to non-English speaking Europe.

You have nothing but appeals to ignorance. Our Second Amendment declares well regulated militia a States' sovereign right.

It's my second amendment
Government has no rights, therefore, it has no second amendment it wasn't written for its protection, it was written as a mandate to the government what they must protect the right of the people.
And well regulated means in working order as to be expected it doesn't mean what you believe it means

It is not Your Constitution, European. Your ignorance proves it.

Our Second Amendment is clear about what is Necessary not Optional to the security of our free States. Learn to read simple American English instead of only understanding European.

So?

We already have that.

It's called the National Guard. Every state has their own National Guard. I volunteered and was a member off the National Guard for my state when I was in my 20s. I have no doubt you never even took the entrance exam much less volunteered to serve our nation.

It is not unconstitutional to ban assault weapons.

Clinton did it when he was president. The law lasted 10 years. The bush boy was president when it ended with the republicans in control of the congress so they didn't renew the law.

Your post screams just how down right stupid and ignorant of the law you are.

FYI those weapons he banned in 94 are now in common use in common use weapons cannot be banned constitutionally

No, an AWB would be unconstitutional because the guns banned are in common use and entitled to constitutional protections.

No it would not.

Clinton already banned assault weapons but the law only lasted 10 years.

It expired when the bush boy was president with his republican controlled congress so they didn't renew it.

The nra already challenged an assault weapons ban in the Clinton years and it was ruled constitutional.

As was established decades ago, we already have a well armed militia for each state. It's called the National Guard. Every state has their own National Guard that the governor of the state controls.

I'm shocked you didn't know this.

From English speaking Europe not from where You are from. You need to learn English of the Americas, now.

"A State Militia must be maintained and well regulated"

I.e., Militias, under control of States, must be made to exercise and floss regularly, observe other such personal hygienic practices, and consume a high-fiber diet.

STUPID FUCK. The 2A refers to a right of the PEOPLE, free and clear of the government, to carry and bear arms against the GOVERNMENT, and you think it is the right of the government to carry out armies. Show us where it says that here:

Your quote.....A free people ought not only be armed and disciplined.

With 30,000 gun deaths a year, our people are anything but disciplined

.. A weapon of a "States militia" is an assault rifle...
Wherein is such a requisite inscribed in law?

In the absence of any such statutory specificity, one might similarly opine that a weapon of a "State militia" is a cow patty.

No...the Guard is not. The Guard can be Federalized and turned into the regular army.....the militia is civilians....

An Assault weapons ban would take this weapon away from the state citizens, thus negating the right to organize a states militia.
The individual right to possess a firearm is unconnected with militia service, weapons in common use, such as the AR 15, are protected by the Second Amendment.

Finally, you post something intelligent......keep it up.
