The United States constitution clearly states that a "States militia must be well regulated and maintained." A weapon of a "States militia" is an assault rifle. Any ban would violate the United States constitution.

The National Guard has many assault rifles and many other cool weapons. They are the State Militias, who were always ultimately under the command of the CiC. Not the private gun clubs.

"A well regulated Militia," means trained in the art of war.

Why are all the right's gun arguments like bad movie plots? Just say you like having guns and shooting guns and that they make you feel safe. Kind of lacks the punch of your wild predictions of government tyranny, invasions of zombie-like urbanites invading suburbia and civil wars. No. The state retains the right to form a state militia, and to regulate it. That is commonly known as the State Guard. It is under the authority of state government, and can not be legally formed by random citizens usurping that authority. You and your buddies can't form a legal state militia just because you bought some guns and camo, and want to.
We need government. you love the strong central government. When it is on your side. And that is all you know. We do not trust the strong central government. And in certain states we see the results of the same thinking that causes us not to trust it.

Ah yes, the Whiskey Rebellion. If you ask me, the beginning of the damn end. Here is the deal. During the Revolutionary War state militias, yeah, ain't that ironic, state militias could waltz up on your farm and kill half a dozen of your cows to feed their troops. Or they could raid your fields, run off with a bunch of green corn and make the troops sick as shit, which happened right after the battle of King's Mountain as they were marching off with prisoners to hang. Great story, Biggerstaff fields, but another time perhaps.

But anyways, after they took your property they would write you an IOU. They were called continental scripts and you can still buy some of them on Ebay today. After the war ended, well the country was a damn mess. Crops were scarce because either the militias had waltzed off wth ith all the corn, or there was no one to work the fields because they were out fighting British and Germans, oh, and Loyalists. Actually, there was exactly one British soldier at Kings Mountain, Fergunson. Another story, another time.

Now the farmers, the people, they were hungry. They needed food, they needed seeds. Hell, they even needed cows. But all they had was this shitty ass piece of paper given to them by some numbnut militia colonel, As if the broke states were going to be able to honor that IOU. Now people like George Washington, Alexander Hamilton, John Adams, oh, and Robert Morris who actually financed the damn Continental Army, sent agents out into the lands to purchase those continental scripts for pennies on the damn dollar. But hey, at least those farmers could feed their kids.

But then there was the second Continental Congress. And we got ourselves a Constitution. But then it was bend over you American people and you don't get any vaseline. One of the first acts of Congress was to pass a law that paid for those scripts, dollar for dollar. Those "speculators", like Washington and Hamilton, made out like freaking bandits. I mean we are talking returns of ten times their initial investment. And to add insult to injury, well you know how they raised the money to pay for that shit. With a damn tax on whiskey, which is how the farmers freakin stored their corn. And it was a per gallon tax, unless you made a few thousand gallons, then you only had to pay a flat fee. Know the only person that made a few thousand gallons. GEORGE WASHINGTON.

It does say that, "A well-regulated" militia being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed." It does not state that the militia is formed by the state, only that a well-regulated militia can be formed from the civilian population, using their own weapons, to protect that state from an enemy.
The founders recognized that the major players that helped the Continental Army win the war against England, were the "private" citizens who formed "their own regulated militias" and, who defended their states, while on occasions working in conjunction with the Continental Army. But, they were not officially state militias, only private citizens that formed groups using guerilla tactics to beat the British Army.

Seriously? The state militias were woefully inadequate. They sure as hell were not "major players". I mean I will stand up for the North Carolina militia, and I will admit that Morgan's rifleman were drawn in a large part from the state militias of Virginia and North Carolina. I will even grant the Swamp Fox some credit. Which the movie "The Patriot" was pretty much a combination of Morgan and the Swamp Fox. But no, the victory in the American Revolution is due to the Continental Army, which was whipped into shape during the winter at Valley Forge by a flaming ass gay dude.
 
The National guard performs militia duties nowadays the regulated militia that served during the civil war and revolutionary war were abolished in 1901.
 
The only legitimate militia is the National Guard, which is under the command of government. Only a duly-elected government has the authority to establish the regulations necessary for a "well regulated" militia and maintain it well. It is impossible for any other group, gang, club, whatever, to establish legitimacy because it cannot show that it has the approval of the state's citizens to represent them. It cannot be self-appointed or self-authenticating.
