It is a complicated case, the detectives have to get all their ducks in a row. They are looking for a motive, if they can show it just wasn't an "accident" , it can mean a lot more time in the joint or even the chair.

If Alec were a police man the Capital he could shoot anyone he wished, even if they were an unarmed woman, and be a national hero because he protects all the important people.

However, shooting for any other reason, it gets dicey.

He already has been, further, he's not going to jail, he'd already have been arrested if such was in the cards, he is being left to the civil justice system, where he will be found directly liable for Hutchens death and the Hutchen family handed a multi-million dollar award! He belongs in the can though, a textbook case of negligent homicide if ever there was one, the bar has easily been met, that they have not acted upon the obvious indicates they have no intention of ever doing so!
