Let’s Give Up on the Constitution

The left sees the constitution as an erroneous document written by white, male, slave owners. Beto O'Rourke intends to run on a platform of abolishing the constitution. The left is importing a replacement population that neither knows nor cares about the constitution. Unless we abolish the left, the left will abolish the constitution.

"AS the nation teeters at the edge of fiscal chaos, observers are reaching the conclusion that the American system of government is broken. But almost no one blames the culprit: our insistence on obedience to the Constitution, with all its archaic, idiosyncratic and downright evil provisions."

snip....

"This is not to say that we should disobey all constitutional commands. Freedom of speech and religion, equal protection of the laws and protections against governmental deprivation of life, liberty or property are important, whether or not they are in the Constitution. We should continue to follow those requirements out of respect, not obligation."

snip....

"If even this change is impossible, perhaps the dream of a country ruled by “We the people” is impossibly utopian. If so, we have to give up on the claim that we are a self-governing people who can settle our disagreements through mature and tolerant debate. But before abandoning our heritage of self-government, we ought to try extricating ourselves from constitutional bondage so that we can give real freedom a chance."

Older piece but still relevant. Don't like the rules?
Change them.

The consitution has ways "out" built in, The amendment process, either via the legislature/states or the States themselves via Article 5 Conventions.

I know how it works, I'm a strict Constitutionalist. The Left screams get rid of it every time they lose an election.

And I'll bet that YOUR definition of "strict constitutionalist" doesn't agree with mine.

I wonder if it agrees with mike pences'?What about Christianity?

What's your take on the constitution, religion and christianity?

1) We can ,do and should use the Federalist Papers to "decipher" the original intent.
2) Religion is a private matter that we were intended to be able to freely practice The Left changed all of that.
3) What about Christianity?

No thank you. But if you want to change a system of government, Venezuela is very fertile territory.

They're essentially pissed off the Constitution has no provisions for protections for just some sex fetishes but not others (14th amendment) . And they want to bring Christian bakers to heel by getting rid of that pesky 1st Amendment too. Getting rid of the 1st also is handy in controlling speech in favor of the LGBT agenda. Also it's hard to establish an official state religion of LGBT (PA laws) with that darned 1st Amendment getting in the way all the time.

I guarantee you the operatives behind the 'down with the Constitution!" movement are LGBT cult activists who are frustrated that they're losing their grip on the nation: by force or by fear.

The DOW hovers around 26,000, unemployment is at a historic low and the GDP is over 4% and yet the crazy incoherent left insists "the nation teeters on the edge of fiscal chaos". Has the left become willing or unwilling stooges of foreign socialist propaganda?

Both “originalism” and “living constitutionalism” are failed, wrongheaded legal dogma.

As Justice Kennedy explained in Lawrence:

Had those who drew and ratified the Due Process Clauses of the Fifth Amendment or the Fourteenth Amendment known the components of liberty in its manifold possibilities, they might have been more specific. They did not presume to have this insight. They knew times can blind us to certain truths and later generations can see that laws once thought necessary and proper in fact serve only to oppress. As the Constitution endures, persons in every generation can invoke its principles in their own search for greater freedom.

The issue therefore is not to attempt to reconcile “originalism” and “living constitutionalism”; rather, jurists should reject both and instead focus on the principles codified in the Founding Document.

That IS "originalism" son.

“Strict constitutionalist” is the same rightwing idiocy as “originalism”; just as failed and just as wrongheaded.

It was the original understanding and intent of the Framers that the courts determine the meaning of the Constitution – the Constitution exists solely in the context of its case law, as determined by the Supreme Court.

“But that’s not in the Constitution” is a failed and ignorant ‘argument.’

Sorry son, you're incorrect.

"as determined by the Supreme Court"

THIS has what has gotten us down the wrong road we have been on for generations. The SC "determines" it based on ideology, not it's intent. The ONLY people who are against the Originalist view are those who like when it keeps them from getting what they want.

You're free to give up on the Constitution if you so choose. Renounce your citizenship and move to Somalia.

There's no Constitution to trouble you there. :)

LOL, learn to read pop.

Did you write that article? I notice the author of it claims to have been a Constitutional scholar then immediately dives into pushing a leftist agenda, which really makes me start doubting his claim.

"our insistence on obedience to the Constitution, with all its archaic, idiosyncratic and downright evil provisions."

"Suddenly, someone bursts into the room with new information: a group of white propertied men who have been dead for two centuries, knew nothing of our present situation, acted illegally under existing law and thought it was fine to own slaves might have disagreed with this course of action. Is it even remotely rational that the official should change his or her mind because of this divination?"

^Yeah, fuck him with that.

"The deep-seated fear that such disobedience would unravel our social fabric is mere superstition."

^Stop right there, motherfucker, because that is exactly your Communist end-game and the point of this article.

We did fine for the 18th, 19th an most of the 20th Centuries, then in the 90's Newt Gingrich fucked up everything by making compromise and civil discourse obsolete.

Then in the 21st Century, a country already divided on ideology, became toxic when Trump made bigotry - racism and misogyny - acceptable; he and he alone released hate and fear out of the closet and people like Mindwars who have no moral compass proudly use the salute of Nazi Germany.
