If Trump's lawyers were smart they would only argue that the law was applied in a legally incorrect manner. As with it's use before, James should have gotten a criminal conviction, or a civil jury trial conviction.

They made $100 million and wanted to do future loans. last thing they wanted was a lawsuit brought by the state government on a matter between two parties, in which everyone was happy.

It can if he sues in Federal court saying the highest state appeals court ignored the obvious lack of due process in using the law used, with no criminal conviction, and no chance of even a civil jury trial.

No he did not. The law as applied does not allow for a jury trial, because it was designed as a method of restitution/punishment for a person AFTER they were convicted of the underlying fraud.

This precedent is a serious threat to the business community and the real estate development industry in NY in particular. One of the reasons big businesses headquarter in NY is the stability, depth and predictability of the law in the state. The Court knows that and will take it into account.

Its only that many elected politicians stink to high heaven and are not even investigated. Menendez should be gone. That may mean one less Prog until election day and we cannot have that. I can see how dictators come to power replacing dictators.
