Biden vows to ban assault weapons 'come hell or high water'

If I laid these challenges once, I laid them a thousand times:

-Please explain to the class why you think a ban - federal or state - on 'assault weapons' will survive the inevitable trip to the USSC.
-Please explain to us how 'assault weapons' do not fall under the umbrella of "all bearable arms".

As many times as these challenges have been laid, there has been exactly zero meaningful response.
The DUI checkpoints were ruled to be unconstitutional too, until they weren`t. They`re allowed because it`s in the interest of public safety said the Chief Justice at the time. Eventually, people will tire of seeing people leaving schools, churches, movie theaters, malls, etc. in body bags. They were denied their Constitutional right of life, liberty and the pursuit of happiness.

Instead of a rational, reasoned argument with references to current jurisprudence, you offer fallacious false equivelances and appeals to emotion.
No real surprise.

Trump had been a democrat for decades…..his anti-gun comment was just that, a comment…..show us the actual actions he took……
And this folks is what scares me about the Republican party.

They will eagerly blow off a blatantly anti constitutional anti 2nd amendment statement from a party leader in the name of protecting Trump, ironically, in this case it is Trump himself.

Honestly, I think if Trump and the right wing media suddenly started singing a different tune about gun rights, y'all would follow them right off the cliff within weeks while the whole time making excuses and blaming Democrats.

Lemmings.

Your false equivalence fails on its merits.

To wit:
Held: Petitioners' highway sobriety checkpoint program is consistent with the Fourth Amendment. Pp. 448-455.
(a) United States v. Martinez-Fuerte, 428 U.S. 543, 96 S.Ct. 3074, 49 L.Ed.2d 1116—which utilized a balancing test in upholding checkpoints for detecting illegal aliens—and Brown v. Texas, supra, are the relevant authorities to be used in evaluating the constitutionality of the State's program. Treasury Employees v. Von Raab, 489 U.S. 656, 109 S.Ct. 1384, 103 L.Ed.2d 685, was not designed to repudiate this Court's prior cases dealing with police stops of motorists on public highways and, thus, does not forbid the use of a balancing test here. Pp. 448-450.

There can be no "balance test" with regard to the 2nd Amendment:

(1) Since Heller and McDonald, the Courts of Appeals have developed a “two-step” framework for analyzing Second Amendment challenges that combines history with means-end scrutiny. The Court rejects that two-part approach as having one step too many. Step one is broadly consistent with Heller, which demands a test rooted in the Second Amendment’s text, as informed by history. But Heller and McDonald do not support a second step that applies means-end scrutiny in the Second Amendment context. Heller’s methodology centered on constitutional text and history. It did not invoke any means-end test such as strict or intermediate scrutiny, and it expressly rejected any interest-balancing inquiry akin to intermediate scrutiny. Pp. 9–15.

How can it be done without eroding constitutional rights?
Actually it's pretty easy. I don't understand why both sides seem to have such a problem understanding this. Most of these people who commit gun crimes are people who have been arrested numerous times and let out numerous times. All we need to do is keep them locked up for as long as possible instead of letting them back out time and time again. It's not a case of finding crazies and taking their guns away. We already know who the crazies are. We just keep them locked up and gun crimes go way down. If we keep them locked up we don't have to take their guns away.

We`re the world leader in incarcerated citizens. Keep your guns locked up and ban the practice of leaving them in a car overnight.
At least 625 were stolen from cars in Nashville in the first 5 months of 2022. That`s 625 taken by non law-abiding citizens.

Amazing how you can't see the forest through the trees. Yes, criminals often get their guns by stealing them and stealing them from locked up places. How about keeping dangerous people locked up so the rest of us can live in peace? I don't give a damn how high our incarceration rate is. It's about time you quit being embarrassed of that fact and come to terms with the fact that the US is full of scumbag worthless people who need to be kept out of society.

No.......stop gun free zones so people don't have to lock their guns in their cars just to go grocery shopping.....and lock up anyone convicted for stealing a gun for 20 years........

It doesn't matter how many are temporarily incarcerated if you keep letting out the most dangerous and violent over and over again.....
