The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

Pollock v. Farmers' Loan & Trust Co. - Wikipedia, the free encyclopedia

This decision, which has not been overturned, says that any direct tax on the people by the federal government must be apportioned to the states population so that bigger states should pay more than smaller states simply because they have more people. Any tax that does not do this is unconstitutional.

The current healthcare bill has taxes in it that do not tax people in proportion to the population of the states so it is unconstitutional for that reason.

Nice try....but once again, you are woefully ignorant in your interpretations of our beloved Constitution. If anything, Pollock vs Farmer shows the bill IS Constitutional

Keep trying though...it does get amusing

From what I understand, the Pollock decision is made irrelevant with the ratification of the 16th Amendment.

The Pollock decision was made irrelevant by fascists Justices who refuse to understand that the purpose of the Supreme Court is to protect the people not the government.

"If, then, the courts of justice are to be considered as the bulwarks of a limited Constitution against legislative encroachments, this consideration will afford a strong argument for the permanent tenure of judicial offices, since nothing will contribute so much as this to that independent spirit in the judges which must be essential to the faithful performance of so arduous a duty."

That is only for income taxes. All other taxes are still subject to the equal propor* aspect of the constitution.

How about the 'race tax'? The tax that is leveled against whites; whites are the major users of tanning salons.

Actually just having a tax on salons is a violation of the constitution because I'm guessing that their are more salons per proportion of the population in ice cold michigan than in Hawaii.

The IRS is going to grow even larger and more powerful under this Health Care travesty. Now they're just going to take Health Care fines from citizens' Tax Returns. Just sounds so Un-American.
