They will because the States broke the Federal Laws regarding the Ballot dates.

Attempts to make these federal issues have failed spectacularly. Giuliani got slapped around by the trial judge in PA. Then he got slapped around at the appellate level a week ago and immediately said he’d appeal to SCOTUS.

He hasn’t.

Mark Kelly lost his appeal at the PA Supreme Court and has appealed to SCOTUS. The problem is the matter has zero to do with federal law. It has everything to do with whether a PA state law is against the PA constitution. You know who doesn’t decide whether a state law is against the state constitution?

What happened in Bush v Gore? Let’s review because it doesn’t help you at all.

The Florida SC had a certified election result but ordered a manual recount of all counties in Florida. SCOTUS determined that the recount would not get results before the safe harbor provision at which time all legal disputes are to be settled. The safe harbor law is federal which makes it a federal issue.

The safe harbor date is Tuesday, by the way. So going by Bush v Gore (which also isn’t precedent) you guys have four days to do something.

The other problem is that enough states have already certified to give Biden a victory. And their plan to have state legislatures chose the electors suffers from the same problem as when Florida sent two sets of electors in the 1800's.

We have a divided congress, which means no electors can be thrown out, and the winner is determined by having a majority of electors appointed. So if an extra 44 Trump electors are sent, bringing Trump to 276 electors representing Trump, that also pushes the number of electors needed to win from 270 to 292.

Oh snap. You know what that means?
The supreme court can only take cases that have reached the highest level they can within the state.
If their supreme court says, they'll take it later, it means it can't be appealed to the USSC until it goes through them first.

Had they instead made a final ruling on the case, the plaintiffs could appeal that ruling.
