Taking that statement as true. The two questions are, where is the list of items removed from the oval office, needed to control the declassification of those items.

Can you link to where that requirement to make a list of items removed from the Oval Office can be read?

Assuming there is such a requirement, the list would have been left in the Oval Office, I'm sure. What good would it do anywhere else? You'll have to ask Biden to find it. I hope you won't blame Trump if Team Biden is too incompetent.

And more importantly, one must presume that those items were returned to the oval office the next day, so Trump could use them the next day.

I wouldn't presume that, nor would any unbiased prosecutor try to get a conviction based on an presumption. I know the Dems got an impeachment based on presumptions, but that doesn't work in a court of law. Certainly not with the Supremes ready and waiting to tromp on any Soros-backed prosecutor or Judge who tries it.

If he brought them to the office the next day, they would still be unclassified, and remain so until Trump classified them again.

Remember, he said any document that leaves the Oval office. So, unless you think he was somehow able to take documents out of the Oval Office after he was not longer president, whatever he had with him was de-classified.
