The Constitution did not adequately define the role of the Judicial Branch, especially when it came to the checks and balances Madison and Hamilton spoke of. That was determined by the SCOTUS in Marbury verses Madison. That single ruling, perhaps the most important ruling in American Judicial History, made the Constitution the supreme law of the land. Before, it was just a statement of ideals and principles.How so? By not allowing the judicial branch to enforce laws?
