That was determined by the SCOTUS in Marbury verses Madison. That single ruling, perhaps the most important ruling in American Judicial History, made the Constitution the supreme law of the land. Before, it was just a statement of ideals and principles.

By asking the regime to obey a court order? If members of the regime think the judge has exceeded his authority they have the right to seek judicial relief by appealing the order. What they can't do is blatantly ignore the order.........as they have done repeatedly with a variety of court orders.
