That was determined by the SCOTUS in Marbury verses Madison. That single ruling, perhaps the most important ruling in American Judicial History, made the Constitution the supreme law of the land. Before, it was just a statement of ideals and principles.

Judge pleads with Trump administration for “reason over rhetoric” in deportation case​

A federal judge said the Trump administration is falsely blaming him for a crisis of its own making: the rushed deportation of seven men to South Sudan in violation of court orders and constitutional due process.

U.S. District Judge Brian Murphy said Monday the hurried deportations were an overt violation of orders he put in place weeks ago, which required the administration to provide “meaningful” notice before deporting people to countries where they could face torture or death. Even after the violation, Murphy said he exercised restraint by not forcing the administration to bring the seven convicted violent criminals back to the United States.

“It continues to be the court’s hope that reason can get the better of rhetoric,” Murphy wrote in his withering Monday night order rejecting the Trump administration’s demand that he reconsider or delay the effect of his ruling. “The orders put in place here are sensible and conservative.”


Asking the regime for reason is like asking trump to admit he really did molest the 26 women who have accused him of various kinds of sexual assault. It ain't going to happen.

Trump supporters might be surprised at how far the Constitution extends toward non-citizens once they're inside the country, however. Cases extending back to the 1800s, including ones brought by Chinese immigrants challenging the arbitrary seizure of their property, have established the rights of non-citizens under the Fourth and Fifth Amendments including due process and the right to a jury.

Again, this was all settled in Marbury v. Madison. The president sets foreign policy, he has every right to do so. But, he has to follow the law, and the Constitution is the Supreme Law of the land. It is the job of the courts, to be a "check" on monitoring the president and making sure he abides by that law.

It is fascinating. It all started with the election of 1800. A rematch between Adams and Jefferson, the same two candidates in 1796. It was perhaps, the most bitter election in American history. It ended in a tie and was one of two elections in American History decided by the House of Representatives, after like over 35 votes.

So Adams makes a last minute flurry of appointments to, well what do you know, the courts. Yep, those lower courts. Something like 60 appointments. They were called the Midnight Judges. They were all approved by Congress. Interestingly enough, it was Judge Marshall's brother that was tasked with delivering the commissions, and admirably, he delivered most of them. But Marbury, and a few others, did not receive their commission before Jefferson was sworn in.

Jefferson instructed his Secretary of State to not deliver those commissions. In his eyes, since the commissions were not delivered before Adams left office, they were null and void. The SCOTUS felt otherwise and issued a mandamus--yeah, look that word up, forcing Madison to deliver the commissions to Marbury and the others.

Your just stupid. The courts are not running the executive branch, they are interpreting the law and protecting the rights of "the people". The fourth and fifth amendment clearly extend their protections to non-citizens, even illegals once accepted inside the country. The right to due process has been a fixture within US law for more than 200 years.

Marshall's quote also clearly implies that the lower courts have the same powers as the SCOTUS, although the SCOTUS has the final say. Trump has the right to an appeal of any lower court ruling. Too bad is legal team is a bunch of flippin idiots.
