Judge dismisses human smuggling charges against Kilmar Abrego Garcia, who was mistakenly deported

I wonder who else saw this coming. Once again, the Judge tosses another case based on 'Trumped up' charges!
Will the Govt. leave this poor dude alone..I seriously doubt it~



A human smuggling case against Kilmar Abrego Garcia, whose mistaken deportation helped galvanize opposition to President Donald Trump’s immigration policies, was thrown out Friday.

Abrego Garcia’s deportation to El Salvador last year became an embarrassment for Trump officials when they were ordered to return him to the U.S. Abrego Garcia claimed that both the timing of the criminal charges and inflammatory statements about him by top Trump officials demonstrated that the prosecution was vindictive.

U.S. District Judge Waverly Crenshaw, ruling from Nashville, granted Abrego Garcia’s motion to dismiss for “selective or vindictive prosecution.”

The ruling amounted to an extraordinary rebuke of a Justice Department that under President Donald Trump has repeatedly been accused of targeting defendants for political purposes. The Trump administration touted the charges against Abrego Garcia last year at a press conference in which then-Attorney General Pam Bondi declared, “This is what American justice looks like.”

“Kilmar Abrego Garcia is a victim of a politicized, vindictive White House and its lawyers at what used to be an independent Justice Department,” his criminal defense attorneys said in a statement after Friday’s ruling. “We are so pleased that he is a free man.”
 
What are the prospects for that decision not being reversed on appeal?

Quite poor.

Of course the judge’s decision is almost certainly going to be appealed. And, once again, a higher court will probably have to overrule it.

I think DOJ is actually happy about this.

The pending criminal charges were the only basis for Judge Xinis keeping him in the country.

Now he can be scheduled for removal to a third country -- Liberia for him?? I don't remember.

Judge Xinis has NO BASIS to prevent that.

Judge Murphy up in Boston has been told 3 times by SCOTUS to stop interfering in Third Country removals.

If his travel is arranged, they might even take him back into ICE custody to process him for removal.

It'll be interesting to see if Judge Xinis thinks she has any jurisdiction in that circumstance.

A perfect example of why AI computers would be better judges than human biased judges.
 
Such legal vindications provoke the convicted felon's insatiable need for vengeance.

Perhaps Trump could pleasure himself with rusty pins and voodoo dolls aplenty, and stop diverting our courts from legitimate matters.
