The president does not have the authority to do what the EP did IF Southerners are legitimate citizens. You have the Constitutional protection of the 4th Amendment and you also have Constitutional guarantee of habeas corpus. The "exception" is if you are an enemy of the state at time of war. Under that scenario, the President has the right to seize property as "spoils of war" and can also deny you ANY Constitutional rights.

Now... If you can show me anywhere in the Constitution where the President is given the power to seize my property without due cause or suspend my rights under habeas corpus... feel free to post that! I can tell you, because I know for a fact, that's not in the Constitution.

Of course, under the powers of war the Commander in Chief has exceptional powers granted for that reason. This is why Bush could detain enemy combatants at Gitmo.... or FDR could intern Japanese-Americans during WWII.

In doing so, he must recognize the South as an enemy nation at war with the US (the ONLY way it is Constitutional)... even though he denied this was the case. So it was a very tenuous predicament for Lincoln and he knew it.

Actually, Congress never declared war. It didn't even authorize Lincoln to raise an army. Everything he did was extra constitutional.

I never said Lincoln fought the war to free the slaves. He fought the war to save the United States from breaking apart.

The south fought the war to keep their slaves.
