Another GOP lawsuit shot down in court

A federal judge in Nevada has just denied an emergency request from state Republicans seeking to stop the use of signature-verification machines. The decision came in response to a lawsuit filed yesterday by GOP groups, who sought to prevent the use of such machines in the Clark County ballot-counting process. (If this lawsuit is ringing any bells, it’s because a similar lawsuit requesting a halt to the processing of mail-in ballots was filed — and rejected — in a state court earlier this week. A request for an emergency stay was also rejected by the state Supreme Court.) In today’s hearing, Clark County’s lawyer said the county— which includes Las Vegas — had about 63,000 mail-in ballots that still needed to be processed before they could be counted. Though Nevada is apparently done counting ballots today, there are still around 120,000 total ballots that remain unreported in the state, where Biden currently leads by 22,657 votes.​

Republicans are claiming that former Vice President Joe Biden’s lead is due to rampant voter fraud and both sides are locked in multiple legal battles in various states. On Thursday, the Nevada Republican Party announced that its lawyers sent a criminal referral to Attorney General William Barr alleging that at least 3,062 cases of voter fraud have been committed in the state.

Nevada Republicans say they have discovered more than 3,000 instances of voter fraud in the state and are demanding an investigation from the Department of Justice.

The state’s Republican Party on Thursday announced that its legal team had asked Attorney General William Barr to investigate what a letter to Barr called “criminal voter fraud” in the state.

“Our lawyers just sent a criminal referral to AG Barr regarding at least 3,062 instances of voter fraud,” the Nevada GOP said on Twitter. “We expect that number to grow substantially. Thousands of individuals have been identified who appear to have violated the law by casting ballots after they moved from NV.”


Nevada law limits the people who can vote after leaving the state to students as well as service members or their families, according to The Washington Post.

“Of course, voter fraud is a serious federal felony, one that cuts to the heart of representative democracy” said the letter, which was shared on Twitter by Tim Murtaugh, communications director for President Donald Trump’s campaign. “We understand that these are serious allegations and we do not make them lightly.”

In a separate letter to a lawyer representing Clark County, which includes Las Vegas, the Republican Party said it expects the list of those who voted after leaving the state to reach about 6,000 names.

Nevada Republicans further noted that they had identified instances of people under age 18 casting mail-in ballots.

Ironically, 1/2 of those fraud voters could be from either party. And the key is whether Nevada WOULD HAVE CAUGHT these.. That kind of check is not done during the counting. It's done after the tallies and before certification.

What we DON'T know is if states PRESS CHARGES in each and EVERY case they find. Might have been better to let this lie and see if Nevada DID alert authorities TO ALL the illegal voting.. But the GOP is in a rush here- And we'll never know if it would have been handled properly..

You are right that if fraud is ever found, it should be PROSECUTED by the State, and that is the path to follow...not lawsuits throwing mud and hoping some sticks....

Florida election law and election standards were loose as a goose, prior to the 2000 election fiasco.

After the election was settled, the Florida legislature went to work, repairing and strengthening their election laws.

Hopefully, these other states, will do the same!!!

After the election was settled, the Florida legislature went to work, repairing and strengthening their election laws.

That's not for the judge to handle.... if there are a few people who did illegally vote in dead people's name, or illegal out of staters, then that would be law enforcement' s job.... the judge would do that nitty gritty work, not their job.

By the way a news station took the first 50 on Trump' s list then another random picks on the list, did investigative work to determine if what Trump team was saying, had any validity....

Something the Trump legal team should have done themselves before bringing this frivolous and embarrassing lawsuit.... before the court and they found ZERO illegal ballots cast that were out of staters the ones that were cast, were cast by military wives and husbands that were out of state due to their spouse's transfer out of state.

Same with another lawsuit for alleged dead people on voter rolls, investigative journalists took first 100 or so on the Trump list plus some others randomly, and not a single vote was cast in the name of those dead people since they died.... there was 1 in another state from a republican, who voted in his dead father's name.... but the system, caught him.

I'm not saying there are states that do not need to tighten up their voter roll dead people, or other things like non citizens if there are any etc.... They should all look at Minnesota as an example....their methods of keeping their voter rolls clean is excellent....

But these are things that are outside of this presidential election, especially since there is no means, in any way, any of them, would change the result of Biden's win and Trump's loss.

What Trump is trying to do is burn the house down on his way out because he lost, burn America down and all that made us great, and the Trumpet republicans are assisting him is what it looks like to most Americans. It is Trump that is trying to STEAL the election from Biden, who overwhelmingly won it!

A Nevada hearing has revealed a host of election irregularities including: the obstruction of witnesses by the United States Postal Service; ballots cast by dead people; improperly calibrated signature verification machines; and election inspections where less than one-third of the GOP’s demands were met.
Since the election contest case was filed, a host of developments have occurred regarding officials receiving access to inspect voting systems and data revealing the extent of fraud in the swing state.
Obstruction.
One such development is that the United States Postal Service (USPS) is “preventing witnesses and whistleblowers from testifying,” concerning wide-scale orders for workers to deliver ballots to nearly 8,000 “undeliverable” addresses. The ballots were later “collected, turned in, and presumably counted.”
100,000 Forged Ballots.
The findings reveal over 40,000 duplicate ballots and 1,500 deceased voters:

• Out of State Voters: Almost 20,000 Nevada voters had a non-Nevada mailing address;
• Non-existent Addresses: Approximately 8,000 voters had registered addresses that are physically non-existent;
• USPS Flags on Non-Residential Addresses: approximately 15,000 voters are registered to vote at either a commercial address or a vacant property;
• USPS Flags on Vacant Addresses: Almost 6,000;
• National Change of Address Out of State: 2,468 voters legally changed their address to another jurisdiction or state or country;
• Deceased Voters: Almost 1,500 Nevada voters listed as deceased by the Social Security Administration (SSA) Master Death File, Consumer Data Vendors, Public Obituary Data Matches, and Credit Bureau Deceased Data voted;
• Duplicate Voter Registrations: 42,000 voters voted twice and have multiple voter registration numbers associated with substantially the same name, birthdate, and address.

‘Guided Tour’
While legal teams in Nevada that sought inspection of the voting machines and systems in Clark County saw their request granted, the Trump campaign legal team slammed the evidence they were offered as little more than a “guided tour.”

The forensic team requested the following 11 items:

• Inspect the Tabulation Server;
• Inspect the memory on the Agilis signature verification machine;
• See a “test run” of the Agilis signature verification machine;
• Inspect the memory on the “adjudicator” machines;
• Inspect the USB drive for the dominion machines;
• Inspect the poll books;
• Inspect the memory of the Election Management Server;
• Inspect the “mail ballot readers” or “ICC’s”;
• Inspect the election results drives in the box from the Accuracy Certification Board;
• Inspect the simulation drives in the box from the Accuracy Certification Board;
• Inspect any “ballot marking devices”.

Instead, inspectors were only granted four requests: gather machine serial numbers; witness a voting receipt tabulation for just 42 votes; inspect reports from the Accuracy Certification Board; and watch a machine be powered on.
In addition to improper calibration and low image quality, Nevada law stipulates that “the clerk or an employee in the office of the county clerk shall check the signature used for the mail ballot in accordance with” detailed procedures, “which do not include relying on software to verify matching signatures.”
Despite this, Agilis machines independently verified 30% of the signatures without ever having human eyes inspect those signatures.
The hearing began on Thursday December 3rd at 1:30pm PST at the First Judicial District Court.
