it wasn’t an illegal appointment. It was (again, at worst) a mere procedural error.

And it can still be easily corrected for a couple of reasons including, but not limited to the AG’s subsequent ratifications of the indictments — which included naming the prosecutor as a special prosecutor.

Assuming that all fall flag (which is surely a possibility, I concede), all that needs to be done is to appoint a prosecutor who will be given Senate confirmation. After all, the government has leave to represent.

A violation of the appointments clause is invalid. But assuming that the judge was right on the law, it still doesn’t call the appointment “illegal,” you rat faced turd.

You cannot claim two primary residences. It's against the law, like I said my second property cost me 4 times more than in taxes than it does now. So she also committed tax fraud also.
She did not avoid taxes or falsely claim two homes as her primary home and is not charged with that either, silly one....sheesh!

She had 1 primary home for tax purposes, and paid her taxes properly....there are no charges for anything illegal on that....

She is charged with getting a better mortgage rate....that saved her only +/- $600 a year, over the 30 year life of the mortgage....if she did lie on her mortgage app, (which she didn't.). Charges are never brought on anyone under her circumstances again from what I have read, therefore it is among other things, an illegal vindictive or selective prosecution.

And her niece that lived in her second home, doesn't pay her aunt rent....which her niece testified under oath in a previous grand jury brought in that failed to indict.....

That really sucks!

It is such a loophole for gov't to be able to extend a statutory time limit for an indictment...if it means how it reads or seems to mean...

All the gov't has to do is make mistakes purposely, to get the charges dismissed, and it buys them another 6 months to get prepared to indict again!
I understand the frustration but I want to push back a bit.

It's never a good idea to look at laws from what happens in extreme circumstances.

The DOJ is not supposed to operate this way and it usually doesn't. It's not really a loophole it's a way to prevent defendants to run out the clock on indictments by abusing the appeal process or getting of on an honest but benign mistake from the prosecutor.

I also would take heart out of the following. The facts of this indictment were so flimsy Halligan despite lying about the law to the GJ only succeeded to convince 14 out of 23 people to approve 2 of the 3 charges, this while she was the only one presenting the case, no judge, no defense lawyer.

I find it highly unlikely that a different prosecutor will fare any better and the chance that they'll be able to convict near nil.

My biggest regret is that this means it's likely all the misconduct of Halligan now becomes harder to prove because the case as it is now is likely dead. And I would have enjoyed her trying to defend all this in front of the bar.
 
Is correction, the technically doesn’t change the facts of the case and erase the illegal criminal acts of these dembots
