It was a shit ruling TBH. She was legally appointed, but the Senate screwed up by not getting that confirmation done. That rests on Thune's desk.
 
The dismissal was based on the appointment of the Prosecutor. The charges were not set aside, so that means that another prosecutor can still bring the charges.

Except other prosecutors refused to bring these charges, this is why Trump appointed Hooligan to start with.

Um, it's obvious you don't understand basic civics. The prosecutor, or prosecutors don't bring the indictment....a grand jury did. Obviously, there was evidence to support the indictment, since a grand jury of their peers brought it.

The ruling here doesn't change the facts of the cases against these scumbags.

Of course, this indictment had so many other problems, like the Grand Jury never voting on it, or information being withheld.

They just refused dropping her case and it's going to proceed. Hopefully she has a big dose of karma coming and she also gets tried in a red state. That way she can feel the bias Trump felt.

Comey was charged with perjury on the question of him authorizing anyone at the FBI to leak to the press. As proof of this they claim that Dan Richman leaked information to the press. Something they tried to charge Richman for under Bill Barr but it was ultimately dropped then.

Thing is Dan Richman didn't work AT THE FBI at the time of the leak. So even IF you can prove Comey leaked anything, his answer would still be truthful.

Do you understand that approving an indictment is done by simple majority. In a room that only has the GJ, the prosecutor and someone to take minutes present. That there is no defense counsel, or judge. That the standard for approving an indictment is simply probable cause. Meaning the possibility a crime was committed is enough. Are you aware a judge who looked at those minutes all but said Halligan lied about applicable law.

And that despite all that all she managed was getting 2 of 3 approved by securing only 14 of 23 jurors.

What's your point about the number of votes? Yes, I know what a Grand Jury is. It's not a trial, it's just hearing the states evidence and determining if there is enough evidence to move forward and indict

The Grand Jury said there was in these cases, not the prosecutor.

Why would she want a bench trial instead of a jury trial?

The Grand Jury said there was in these cases, not the prosecutor.
But the prosecutor is their legal counsel in this context. And again that legal counsel lied to them when they asked questions .

And what my point is, is that you are convinced Comey is guilty because of the "facts of the case" despite the fact that Halligan wasn't able to convince a full Grand Jury under the probable cause standard of that guilt. She barely managed a majority for only 2 of the charges.And this despite misinforming them.
