No one considered them official FBI documents until the IG made that determination, so how are you going to prosecute Comey for having documents which no one considered official records?

The documents were not communications with the president. They were Comey's recollections of his conversation.

Sorry, but as we all know the prosecution has to prove that Comey DID know they were federal records. That's how the legal system works. Since you can't prove that, you have no case.

A criminal referral is a recommendation to pursue criminal charges. That didn't happen. The IG submitted the report as required by law. There was no request for a prosecutorial decision.
