He isn't defying the Supreme Court (well he may have with his already rolled out discharge of debt for people who borrowed less than 12K but not his other stuff). The Congress already delegated a lot of authority to the Secretary of Education via the Higher Ed Act when it comes to student loans and they have been going through the normal rules-making process using those authorities since the whole SCOTUS trip to the woodshed. It is unlikely anything he announces will get implemented before he leaves office if he loses though.
