WASHINGTON (AP) — The Supreme Court refused on Monday to allow Texas to enforce restrictions that would force 10 abortion clinics to close.

The justices voted 5-4 to grant an emergency appeal from the clinics after a federal appeals court upheld new regulations, refusing to keep them on hold while the clinics appealed to the Supreme Court.

The Supreme Court order will remain in effect at least until the court decides whether to hear the clinics' appeal of the lower court ruling, not before the fall.

This is not quite what you think. This is nothing more than an administrative matter. The course is being appealed to the Court. Temporarily staying the lower court's ruling is business as usual, not really having anything to do with the case itself. Preserving the status quo is the appropriate way to handle things while the appeal moves forward.

Stays are generally granted if there is legal controversy. I'm not misinterpreting this as anything but a delay of the rules until the fall, when the court will rule. Which way the court will go is anyone's guess.

But repealing rules in the fall after the clinics have already closed is pretty pointless. Repealing the law in fall while all the clinics are still open?

Even better.

Just one more step in the destruction of our federal system. States have the exclusive right to regulate the practice of medicine with their borders.

Not when their attempt to regulate medicine is a blatant attempt to close down abortion clinics to try and limit a woman's right to abortion.

It would be like the EPA trying to regulate lead in the environment by banning bullets.

Providing a safe medical environment to everyone is a compelling interest of the State, if abortionist want to operate within the State they can meet those safety standards or take their shyster doctors elsewhere.

"States have the exclusive right to regulate the practice of medicine with their borders" as long as individuals' civil rights are protected, yes.

Civil rights have nothing to do with the safe practice of medicine, women are dying across the country because clinics are not equipped to handle complications that arise from abortion. Texas has every right to address that issue and I think the court will agree, well who knows, laws, the Constitution and words don't mean anything any more, last week proved that.

When you are knowledgeable enough to talk about this issue, OKTexas, instead of knee jerking, let the rest of us know, please.

Pales in comparison to the shit storm that will happen if this gets through the Senate

H.R.1797 - 113th Congress 2013-2014 Pain-Capable Unborn Child Protection Act Congress.gov Library of Congress
Obama would veto it..........and then they would have to override it.............and they don't have the votes............

Will not happen.......but late term abortion is an ABOMINATION to anyone who has watched the procedure..............

If they can't decide by week 20, then I agree they shouldn't be allowed to abort unless their health is in danger.........5 months and go NOPE is ridiculous.

Hope it passes.............and force Obama to veto it.........at the least........been in Reid's Graveyard for a while.

Fuck off asshole, you're the one trying to make this personal, not me. Break my argument if you can, oh that's right, no need to break an argument when you can use alinski rules and just be dismissive. That crap doesn't work with me.
