Irrespective of whether you believe this guy deserved to be charged with a crime (and I would base my opinion on that on whether it is believable that he thought the girl was of age) how could ANYONE believe the girl shouldn't be charged with something?

In actuality , in these situations the girl should be charged with accessory to statutory rape.

If two guys are at a party and one guy tells the other that a minor is of age and he has sex with her, the first guy is an accessory, so how is it any different if the girl herself tells the guy she's of age?

Sounds like they went with a guilty plea as part of a deal too - no jury trial. That's not uncommon as prosecutors will charge you with everything they can, much of which gets dropped if you plea to lesser charges. But it's designed to intimidate people ignorant of how that works. If they can get their agreement to the deal revoked and get a jury trial that's their best bet.

Would take a closer look at the judge as well if on the state's bar association or whoever polices judges for ethics violations or full-on improper behaviour. State HAD an under-21 thing the kid shoulda had working in his favor but the judge ignored it.

he should be punished for the act, as it was statutory. However the labeling him as a sex offender is over the top. His purpose was to have sex with a 17 year old, which is legal, not a 14 year old. He shouldn't be lumped in with people who intend to have sex with 14 year olds.

People need to quit obsessing on whether or not someone's a 'minor.' Minors can have sex in many states. It's just so variable. 16-18 generally, but when close in age exemptions exists this would have been legal in some states, just not apparently this one.

People need to quit obsessing on whether or not someone's a 'minor.' Minors can have sex in many states. It's just so variable. 16-18 generally, but when close in age exemptions exists this would have been legal in some states, just not apparently this one.

In almost half the states it is acceptable to use the defense that the girl misrepresented her age.

Depending on what she looks like, that should be a valid defense.
