Both executive orders and proclamations have the force of law, much like regulations issued by federal agencies. However, in court, the government would have show the legal basis for the executive order or regulation. If the federal government can not show the order or regulation is covered by law or the constitution, the court will strike it down.

The court has to decide to go after it , the executive doesn't have to do anything unless they are asked by the court to defend it. You are kind of ass backwards.
