The president determines which documents are "presidential records," morons. I've already proved that.
And I proved that the documents Trump had were government property.
As all classified materials begin as government property, and after declassification remain government property. The only way for Trump to convert them into personal property is by purchase, or documented legal transfer. Which DID NOT HAPPEN.

Trump can no more declare a document to be personal property than he can declare air force one to be personal property.

This gives the white house time to collect and organize the millions of pages of presidential records gifts, and other property of the office. And to archive, duplicate or transfer them to the incoming administration.

Actually, most presidential records are in digital format and are stored at an NARA facility. However, this achieving of documents does not occur daily. When a president leaves office, many documents are found on office servers and computers. Also, handwritten notes, memos received, drafts of presidential speeches along with changes, original documents signed by the president are all found in White House files. Tweets and Facebook documents are also considered presidential document. Vice Predental files are also considered presidential and handled the same as the presidential documents.

On moving day in the West Wing, actually serval days, thousands of documents are transferred to the NARA facility plus various artifacts and gifts. Historians begin a process of going through all of these documents plus those that are achieved to determine documents that have historical or possible evidentiary value. Only 1 in 20 meets that requirement. Those that do are put in standard digital format and indexed for on line research. Those that do not are maintained a number of years and then destroyed.

Another part of the law that Trump ignored. Even though we have reports of Trump repeatedly ripping up papers once he was finished with them. And his aides having to get them out of the garbage, and use clear tape to try and piece them back together again, before sending them to the National Archives.

And that was early in Trumps term.

Toward the end, the aides sent the shards of paper in an envelope for NARA.

The question of classification isn't even important when it comes to the statutes from the search warrant. Trump stole government property PERIOD.
No different than if Trump tried to put the presidential limo into his private garage, or keep AF-1 next to his other jet.

Trump took the documents, destroyed some of them, ignored a subpoena, lied about having them and now it appears he tried to hide them from the FBI. Clinton forwarded some emails written by others that contained classified information stored an unauthorized sever. Trump took hundreds of classified documents filled with classified information. What Clinton did does not even come close to Trump's crimes.
