Even if they reject the Trump administration’s emergency requests, the court could decide to take up the dispute and weigh in on the more central question of whether birthright citizenship is guaranteed in the Constitution once the lawsuits have made their way through the appeals courts.

The problem is, without re-writing the 14th, it hinges on whether a non-citizen on American soil is subject to the jurisdiction of the USA. If ruled not, then a non-citizen is not subject to US laws on American soil.

The authors of the 14th made it clear the only people not subject to the jurisdiction of the USA are ambassadors. I.e, those with diplomatic immunity.

Those are the only exceptions.
