Article 30 of the Mexican Constitution states that Mexican nationality is conferred to, "the individuals born within the Republic's territory whatever their parents nationality might be" as well as individuals born abroad to Mexican parents.

Yes, whatever NATIONALITY that is in the country legally. Mexico does not give citizenship to illegal aliens or their babies

He wrote that EO hoping that it will get taken to court. That's the best way to make the courts definitively rule on birthright citizenship.

1) Of course. I was one of those Republicans whining about it. Then I realized what he was doing. Forcing the courts to rule on the limits of executive power. Most of those orders were upheld, a notable few were struck. Liberals back then used their brains in the courtroom, at least.

2)Donald Trump was a private citizen. Free speech. But even as president he is entitled to change his mind on important issues. And as such he can issue executive orders forcing change, even if it has to go through the court system first. The states are hopelessly divided—enough of them so that there will never be a constitutional convention amending the 14th. The same goes for Congress. This was the best route he had.

Or did you think he was some sort of imbecile? Project much?

The Supreme Court addressed the scope of the 14th Amendment's Citizenship Clause in United States v. Wong Kim Ark (1898). The Court ruled that children born in the U.S. to non-citizen parents were U.S. citizens, provided the parents were not diplomats or foreign enemies engaged in hostilities.

That should have been the definitive ruling about birthright citizenship. But somehow over the years that ruling has been broadly warped and intentionally misinterpreted.

Of course, but I've read that ruling a number of times. I also read what one of the original authors of the 14th said while it was being debated.

It goes right along with it, if you want my two cents. The ruling itself naturally should not apply to children of illegal immigrants, however, and people saying it "implies" birthright citizenship simply for the want of the children of non-citizens being born here becoming citizens, have clearly not read law and precedent on the matter.

Illegal aliens who come here illegally, ARE "foreign enemies engaged in hostilities". The hostilities of violating our immigration laws, thereby invading the country, and in swarms of thousands of invaders.

Jacob Howard, author of the 14th amendment, in 1866, documented his objection in writing (and the court should have carefully noted it) >> "[E]very person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States. This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the government of the United States, but will include every other class of person.[9]
