It was unconstitutional based on Bush V Gore, which made the assumption that the Florida legislature wanted to take advantage of 15 USC 6503, which neither the Florida legislature, or Florida supreme court claimed was their intent.
Which is why the USSC said that their decision would not be cite-able in any other election cases. And why the USSC spent years living down that decision since it violated the principle of letting states interpret their own laws.
