He didn’t have to be since he was already confirmed as US Attorney

He already had the powers. The AG could simply make him a special counsel with the same authority as a uS attorney and that’s what he did

Jack was never confirmed by the senate, so the AG simply couldn’t give him US attorney powers

So if someone is confirmed by a Senate today… that’s supposed to be good forever for any appointment? Even thirty years from now with a totally different Senate?
 
The separation of pres and doj has been that way since Nixon and Watergate. The ONLY president since Nixon to not follow the precedence of Presidents and the DOJ separation is former President Trump.

That's beyond stupid. Senate confirmations are not for life. If an individual is nominated for a position requiring Senate confirmation and they're approved by the Senate, they have to be approved by the Senate again if they are later nominated for such a position.

If someone is confirmed to be a US Attorney, that's good til they resign. That's why Durham, Weiss, and Hur were perfectly legal when tapped to be Special Counsel
