If a person is accused of bank robbery, the cops show up, identifies the 'suspect' the person is arrested and put in jail.
They don't give the person a notice to appear and let them go.

With Red Flag laws guns are taken away first and then you have to fight to get them back. That is not due process....period (and not an Obama "period"). With this law you don't have to commit any crime at all, yet you can have a loss of your rights. You have to fight to get that right back without having even committed a crime. What other rights are you okay with being taken away BEFORE a crime is committed? BTW...I have a good movie I think you would like.

Typically, a judge (or other judicial official such as a court commissioner) hears the request and then decides whether to issue a preliminary order without holding a hearing or notifying the gun owner. These orders are temporary and last from two to 21 days depending on the state.

Seventeen states and the District of Columbia currently have red flag laws, also referred to as emergency risk protection orders. They allow judges to take guns away from people who are deemed to be a danger to themselves or others.
