No, clearly SCOTUS wants Congressional approval. But to avoid the huge disaster the SCOTUS dumped on America, Congress should act to block SCOTUS from causing the disaster.

Trump only cannot levy tariffs under the specific emergency authority that he was claiming.

As I earlier noted, Bessent is unfazed and ready to move forward with other contingencies, the details of which have probably already been worked out.

And Congress is the only branch with taxing authority, including duties.

If congress wants to grant him that authority, they just have to pass a law.
