Teacher and 16, 'almost 17' male victim illustrates the double-standard in statutory sex crimes, as well as the arbitrary nature of such laws. 'Because the victim was almost 17, the age of consent in Texas, the teacher got no jail time.'

Had it happened in California with an AoC of 18 would this have been the case?

If the difference is between CA and TX, then its NOT a double standard, it's two different standards.

Perhaps they were sympathetic to the NBA standard for personal fouls, to wit, "No harm, no foul."

I hardly think an "almost 17 year old" high school student would be traumatized for life by having sexual intercourse with his female teacher.
