The ruling is correct. At the time when the alleged criminal action took place, Trump was not in office.

This does not change the fact that the verdict is - sorry for using legal jargon here - bullshit. There is no cognizable crime here. There is nothing illegal about entering into a non-disclosure agreement, even if it enhances one's political prospects, and Federal campaign finance law cannot be litigated in a New York State court.

The case will be thrown out, the only questions being when and how.

And a doddering, and dementia addled 82 year old will leave the protections of the office, with no further hope or help of being hounded to hell in the final days of his pathetic life.

Judge Denies Trump’s Bid to Throw Out Conviction Over Immunity Ruling


A judge on Monday rejected Donald J. Trump’s argument that a recent Supreme Court ruling had nullified his criminal case in New York, upholding the former and future president’s felony conviction for falsifying records to cover up a sex scandal.

The judge’s ruling preserves, at least for now, the stain of Mr. Trump’s criminal conviction. And if it withstands Mr. Trump’s appeal, it will make him the first felon to serve as president.

The ruling, which addressed the Supreme Court’s decision to grant presidents broad immunity for their official actions, thwarted only the first of several legal maneuvers Mr. Trump has concocted to clear his record of 34 felonies before returning to the White House.

Prosecutors had argued that the Supreme Court’s decision had “no bearing on this prosecution,” noting that Mr. Trump was convicted of orchestrating a scheme involving a personal and political crisis that predated his presidency.

Because they rigged the trial.

They hand-picked the judge and jury and pushed thru a sham trial just so they could claim Trump was a felon.

The so-called crime Trump was accused of wasn't even a crime according to the election commissioner in the state of New York.

Now the judge refuses to sentence Trump so he can't have his sham trial reversed on appeal.
 
We have an appeals process BECAUSE of DA's like Alvin Bragg and judges like Juan Marchon!
You forgot about the grand jury and the trial jury. Both found the evidence convincing.
