Judge Denies Trump’s Bid to Throw Out Conviction Over Immunity Ruling


A judge on Monday rejected Donald J. Trump’s argument that a recent Supreme Court ruling had nullified his criminal case in New York, upholding the former and future president’s felony conviction for falsifying records to cover up a sex scandal.

The judge’s ruling preserves, at least for now, the stain of Mr. Trump’s criminal conviction. And if it withstands Mr. Trump’s appeal, it will make him the first felon to serve as president.

The ruling, which addressed the Supreme Court’s decision to grant presidents broad immunity for their official actions, thwarted only the first of several legal maneuvers Mr. Trump has concocted to clear his record of 34 felonies before returning to the White House.

Prosecutors had argued that the Supreme Court’s decision had ā€œno bearing on this prosecution,ā€ noting that Mr. Trump was convicted of orchestrating a scheme involving a personal and political crisis that predated his presidency.


All most of us want is accountability for crimes committed.

He's been adequately framed by a legal process that is more chewing gum and string than real law. He pregnant broke some minor laws that are worthy of a fine... Certainly not jail and certainly not teens of millions.

His accountant wrote down payments to his lawyer as legal fees.

All most of us want is accountability for crimes committed.
Everyone knows that Merchon was totally biased against Trump...everyone knows that the conviction that Merchon pushed through is going to be overturned on appeal...everyone knows that this was an indictment only brought for political reasons by a DA who is equally biased against Trump. Merchon and Bragg will go down in history as political hacks that TRIED and FAILED to keep Donald Trump from regaining the Presidency with a political show trial!
 
Yet you couldn't argue that with evidence if your life depended on it.

So all.normal adults know you pulled that out of your ass to make yourself feel better.
Luckily, Fort...I don't have to argue that! It will be argued in appeals court. What are you going to say when that conviction is overturned?
 
ONe is a federal crime (HB) one is a state crime (47). One is NOT the same as thenother. Presidential Pardon only cover FEDERL CRIMES!!!!
Well Alvin Bragg screwed the pooch on that one....because he converted a state crime into a federal crime and tried it out of his jurisdiction.

The whole mess would be thrown out on appeal if the judge ever gave Trump a sentence so he could begin the appeal process, but he won't.

The Supreme Court should throw it out on a constitutional basis. They convicted Trump of a crime that wasn't proven by the evidence presented in a court of law.

There is that "Catch 22".
It can't go to the appeals courts until Trump is sentenced, which is on hold until after Trump's 4-year term.
Nothing is going to change. It was a crap conviction six months ago...it will be a crap conviction six months from now...and it will be a crap conviction when it's ruled on in appeals court!
 
The ruling is correct. At the time when the alleged criminal action took place, Trump was not in office.
No, the charge was falsification of business records, and those were the checks to Cohen and the recording of the invoices in the accounting software.

That all took place after Trump was in office. Trump's lawyers were saying that the testimony of Hope Hicks was improper, because she was working in the White House at the time.
