forfeiture actions are not actions against a person. they are actions against a "res' or thing. e.g.,
the city of usmessageboard v $128,000 in assets.

the basis of the forfeiture is that the money came from criminal activity (allegedly). there does not need to be a convocation to do that.

for example. if you use a car in a robbery or to sell drugs, the case will be brought against the car and the car forfeited.

what don't you understand? you don't have to like it, but forfeiture actions are common and have been upheld (over objection) by the courts.

What don't you understand about seizing people's property without a conviction or even a trial being grossly unconstitutional and indicative of a totalitarian state? A lot of innocent have had their property taken from them due to these laws and many never get it back because they can't afford to fight it. Police departments are padding their budgets off of this. This has affected a lot of minorities and lower income people in particular.
