This is a clear violation of the 4th amendment and we’ve seen this in action in jurisdictions around the country.

The memo outlining the policy has been tightly controlled, clearly not wanting this information to get out.


This is the kind of constitutional violation that I think warrants criminal prosecution.
Form I205 is an arrest warrant. Police officers enter people's residences without their consent all the time all over the country under both Republican and Democratic leadership to execute arrest warrants. Can you explain why this is controversial?

 
That warrant comes from an immigration judge, who is an employee of the executive branch. These do not come from article 3 judges and therefore the administration is usurping judicial power for itself.
The warrant is good enough to arrest the illegal on the street and deport him. It's good enough to arrest him in his home.

Yes because those are the judges who deal with this issue. I get that you don't like it but that's the way the Constitution lays it out. I don't recall you bitching about this when all the other past administrations issued immigration arrest warrants though the exact same courts with the exact same form. Wonder why that is.

Exactly. The reason is because democrats have a double standard.

Doesn't matter, law officers can enter a building in pursuit of criminals. Look at it this way, if a cop hears screaming coming from a residence and shots, will he have to get a warrant to go in and investigate? ICE was after 2 illegal, criminal, felons in a residence. They have every right to bust down the door and apprehend them.

Nah. Not an exigent circumstance. The order from the immigration judge and Administrative warrant are all they need.

Moroner is barking his opinion out his ass. The Supreme Court has never addressed this situation. I think they will rule in administration’s favor. There is no rational reason a judicial warrant is required. None.
