Another unforeseen question arises in the error, sorry, era of trump

Minnesota Claims the ICE Surge Is Illegal. A Judge Will Hear Arguments on Monday.

A federal judge in Minnesota will consider an extraordinary legal question on Monday: Can a deployment of federal law enforcement officers be so dangerous and so intrusive that it violates a state’s sovereignty under the 10th Amendment?
No.

Especially if the danger is entirely due to half-assed insurrectionists violently attacking federal officers.

That calls for a surge of national guard to protect the surge of federal agents, not for letting the current government of Minnesota effectively succeed from the union, with no vote to do wo in the state.

You Democrats tried this already, and the USSC ruled you had no right to avoid federal jurisdiction.

IF this strategy of the dems works, and they manage to win, by provoking violence in the streets.
These neo-Confederate Dems have also learned from the Nazis abotu the street fighting.

Truth be told, both Nazis and Democrats learned the effectiveness of street gang politics from the Marxists of Eastern Europe.

This is what a lawless regime looks like in practical terms. ICE has been given carte blanche to routinely violate laws and court orders by someone who is intimately familiar with operating outside of the law. Enabled by his blonde sock puppet. As Americans we must keep reminding ourselves that this is not normal. Typically, the government enforces the law, it doesn't make a mockery of it.

Minnesota judge counts ICE violations at nearly 100 court orders: "ICE is not a law unto itself"

A federal judge is calling out ICE and its alleged noncompliance with court orders connected to actions in Minnesota. The strong statement was made in the context of a court order for a man held without due process.

Juan, who asked WCCO not to use his last name, was released on Tuesday, thereby triggering the cancellation of the hearing scheduled for Acting Director of ICE Todd Lyons. Chief Judge Patrick Schiltz, nonetheless, issued a stern warning.

"ICE has likely violated more court orders in January 2026 than some federal agencies have violated in their entire existence," Schiltz said, adding that he counted 96 court orders that ICE has violated in 74 cases.

"ICE is not a law unto itself. ICE has every right to challenge the orders of this Court, but, like any litigant, ICE must follow those orders unless and until they are overturned or vacated," Schiltz said.

That did not reply to my post at all.

Somehow you missed that my reply directly refutes this........

federal troops are causing the violence.

No, you lying leftard.

LEFTARD SEDITIONISTS are causing the violence.

Tell those assholes to stand down and the violence goes away.

There would be no violence at all if it weren't for the leftards.

Without leftard interference, ICE could make mostly peaceful arrests.

Apparently this idiot judge thinks the Executive Branch reports to him.

Reading reasons for Trump's actions is like dealing with a spoiled child. The man is a cowardly draft dodger who inherited his wealth and thinks like a child. Hopefully American democracy survives the buffoon.

So who are democrats are going to put up in 2028? Democrats are more unpopular than jock itch and herpes

Yep.

None of the claims against were proven.
Democrats have no policies to put forward, everything they touch turns to shit.
A simple factoid.
The lawsuit, filed two weeks ago, argues that the surge in immigration enforcement in Minnesota is motivated by a “desire to punish political opponents and score partisan points.” The state and local governments told the judge that the deployment had panicked residents, endangered public safety and infringed on their ability to carry out basic government functions. Local law enforcement is overburdened, they said, and schools have been disrupted.

Simple factoids.

We'll see how that lawsuit plays out. Can the Federal government enforce Federal Immigration Law? Simple factoid.

It is sad that judges don't automatically throw out ridiculous cases like that.

This is law fare 2.0. They couldn't get the criminal charges to stick. So now they want to hold up everything Trump was elected to do by judicial fiat.

Conservatives, once staunch advocates of states’ rights, endlessly invoking the 10th Amendment to justify their opposition to Federal laws and policies, have become enemies of states’ rights, advocates of an authoritarian Federal government and the tyranny of a despotic Trump regime.

Conservatives are infamous for their hypocrisy.
That hypocrisy thing does swing both ways. Remember when the Biden administration successfully sued Texas and Arizona for trying to do something to enforce the border because the Federal government wasn't enforcing Federal laws and policies? Biden administration won because they convinced judges that only the Federal government had jurisdiction, and the states had no say. I don't recall people like you invoking the 10th Amendment supporting states' right then. So, are you for states' rights or are you for them as long as it lines up with your political ideology?

The Trump administration should put up the cases of Biden suing Texas and Arizona, and winning, as prior case law.

Boy you all just really, really love you some criminal illegals don't you? Including the ones convinced for child rape
They love them because they are the most likely to kill white women. Raping a few children is nothing compared to killing white women.

Bug is still posting his rules’ violating OPs in the wrong forum.

Lawyers for the state of Minnesota, along with the cities of Minneapolis and St. Paul, have claimed that the Trump administration’s surge of some 3,000 immigration agents to the state has crossed the line into an unconstitutional and illegal occupation. They have asked a judge to temporarily halt the surge, which has led to three shootings, thousands of arrests and tense protests.

The Trump administration has dismissed the state’s legal theory, saying in court filings that it “would constitute an unprecedented act of judicial overreach” to expel federal officers from Minnesota. They have argued that Operation Metro Surge, as the administration has named its Minnesota campaign, is fully legal, and that it is up to the federal government to decide when and how to enforce federal laws.

Perhaps MN officials are taking an one step at a time approach. First, at the least put a temporary judicial halt on ICE's activities in the Minneapolis/St. Paul area. The people there have been terrorized by Gregory Bovino's marauding gangs of masked men long enough.

Second (this is speculation on my part) indict the ICE agents involved in the shooting deaths of Renee Good and Alex Pretti. Because this is not yet the country trump and Stephen Miller want. One where federal agents can gun down people in the streets with impunity. Or violate their 4th A rights. Or routinely get away with an excessive use of force. No matter how hard the regime tries to turn the country in to a police state.......this is still America.

I have no idea how the judge will rule. I just know a case like this wouldn't come before a court during any other prez's term. When federal troops have been used in the past it has typically been at the governor's request to control violence. In this case, no such request has been made while federal troops are causing the violence.
Oh cool. Somebody has decided to get a court to make-up the law again.

The thread headline makes this thread an unclean start, too.

Shouldn’t it be in the basement? Mods?
